SUBJECT:- LAW RELATING TO
WOMEN: PROTECTION OF WOMEN
FROM DOMESTIC VIOLENCE ACT, 2005.
INTRODUCTION:-
(1) The biggest problem women face today is abuse. There are two types of violence. Occurred in a public place and be punished under sections 354, 509, 376, etc. Penal Code and another that happens with family as well punished under sections 304B, 306, 498A of the Indian Penal Code.
In a male-dominated society, women have become victims of violence and exploitation. In India, women have social, economic, physical, mental, and sexual. In India, pets violence is rampant but unseen. There is a plethora of loss in various aspects of the women’s problem i.e. demands of dose, sexual assault, murder of women, trafficking, sex abuse, but the most vulnerable area is domestic violence. The concept of gender equality, women's power, etc. given below The Constitution of India, but the equality of status guaranteed by The Constitution is a myth to millions of women, targeted at diversity forums of violence in their homes.
In India, domestic violence is commonplace, but it is rarely seen in public. General rules for harassment, beatings, etc. Violence against women was not enough to address violence against women in domestic relationships. However, consider the guaranteed rights under Articles 14, 15, and 21 of the Constitution, the law “Protection of Women The Domestic Violence Act, 2005 ”was established to protect women victims of domestic violence and preventing the occurrence of domestic violence in the community. The Act in question came into operation on the 26th of October 2006. Legislation passed to eliminate all forms of discrimination against women. It has been a unique combination of social and criminal laws. The law develops not just because see women who are in a live relationship but also to expand the protection of other women in the home includes sisters as well mothers. It is a bonafide law to promote justice for women. The Act adds to existing laws governing marriage, divorce, child care, and property.
DEFINITION OF DOMESTIC VIOLENCE:-
(2) The term “Domestic Violence” refers to any act, the failure or commission or conduct of the respondent will reach domestic violence in some cases. It involves creating physical, sexual, verbal, and emotional or economic abuse harassment which is also defined under the definition of domestic violence. In determining which act, omission, or commission or Defendant's conduct means "Domestic Violence" in general the facts and circumstances of the case will be a guide. Part Rule 3 states any act/action/omission/commission damages or injury or potential harm or injury will be considered 'domestic violence. Even a single act of sending or leaving can do create domestic violence. In other words, women are not required to suffer long before going to law. The law states that any definition of domestic violence is a human right breaking the law. In addition, the law defines the different types of violence they face by women and ensures that those definitions are not limited to\the wisdom of the judges.
(4) Sexual harassment:- is any sexual misconduct that is abusive, degrading, or otherwise demeaning to that person. The law also includes cases where a woman is forced to have sex with her husband against her will.
(5) Verbal and emotional abuse:- are defined as other insults, humor, humiliation, name-calling, and similar acts. A woman who is insulted and ridiculed for saying she can't get pregnant, or because she didn't give birth to a baby boy, can now take help from this law. Any repeated threats of harm to any victim, in other words, if the abuser threatened the victim's children or relatives, would also be included under this heading.
(6) Economic trauma:- is the most advanced thinking, an important part of this definition. Deprivation of economic or financial resources in which the abused woman or child has a right under the law or practice, or what the abused person requires as a result of a need, may be included in the provisions of this Act; withholding such resources is now under the economic category harassment. This provision occurs in cases of marital disputes when the husband wants to deprive the wife of the necessary money such as a weapon. The law also sees a man selling his wife's jewelry and assets as guilty of economic misconduct.
(7) The husband, under this rule, is unable to produce the results of the house, is not able to separate the property or other property where the victim has an interest or right as a result of the domestic relationship. A man may not sell or use a stridhan (lobola) and/or other property jointly or separately held by a woman.
(8) Saraswathy Vs. Babu, AIR 2014 SC (Cri.) 493, the fact is that the applicant's wife has been abused since 2000. The Hon'ble Supreme Court noted that “even after an order issued by a lower court judge, the respondent did not allow the appellant's wife to stay in the family joint family unit, and held that there was a continuation of domestic violence by the respondent's wife. In view of the persistence of domestic violence, it is not necessary for the Courts below to determine whether domestic violence is perpetrated prior to the enactment of the Protection from Women in Domestic Violence Act, 2005 and that the act falls under the definition of 'Domestic Violence' as defined. ”
Purpose and reason:-
(9) The provisions of the Act provide for the purposes of the Act to show that the purpose of the Act is to protect women from domestic violence in their homes. The applicant under this Act will only be a woman. An important aspect of the landmark legislation enshrined in a woman's right to housing or other housing. It provides for a woman's right to live in a marriage or shared family, even though she has no title or right house. This right is protected by an order of residence granted by the Court. The Act does not discriminate between married women and women living in a relationship. It provides equal protection for both of them from abuse at the hands of their partners.
(10) The law is a middle law. The law is vested in the State Government. It is the State Government that appoints the Security Officers, honors the Service Providers and authorizes treatment facilities and home accommodation to accommodate the abused woman. Magistrates and Defense Officers are the compulsory enforcement agencies in this regard. The Act falls into a total of 37 categories. In the event of domestic violence, the abused woman can report the matter to the Magistrate to refer the matter to the Security Forces are affiliated with that Court. She can also go to service providers or security managers for help. The Act obliges them to provide the victim with immediate medical attention and accommodation so that they can stay in a shelter if necessary. The Defense Protector / Service Provider will submit a Home Affairs Report to the Magistrate. If any health care and accommodation is not provided in a proper condition, the Magistrate may order the Security Service to arrange for the victim to be rehabilitated. The victims could be wives, sisters, mothers, or another female relative living in a shared family relationship. Respondents are male and may have female relatives of respondents where the complainant woman is a wife or a person living in a marital relationship with respondents.
BENEFICIARY LAW:-
(11) Under this Act, "Abused Person" means any woman who has been in a domestic relationship with a defendant and who is alleged to have committed an act of domestic violence by the respondent. The term home relationship refers to the relationship between two people living or living at any given time, together in a shared family. Where they are related to eating together, getting married or in a relationship in the form of marriage, adoption or a family member living together as a cohesive family. Even women who are sisters, widows, mothers, unmarried women, or those living with a victim of abuse are entitled to legal protection. Any widow or sister or unmarried daughter who is being abused at home can also apply the new law. The law also protects women who are in deceitful or lonely marriages, or in marriages that are considered illegal. The Act requires a woman or woman living in a marital relationship to lodge a complaint against any relative of the husband. Therefore, if a woman is living with an abusive man, she can take help from the provisions of this law even if she is not married to him. Even women in past relationships as widows have the right to freedom under this Act.
BY CAUSING A COMPLAINT
(RESPONDENT):
(12) The term "Respondent" means any adult male, who has been in a domestic relationship with a victim, and the aggrieved person seeks any relief under this Act provided that the aggrieved spouse living in a natural or marital relationship may also lodge a complaint against the perpetrator. and a relative or a man.
DUTIES OF POLICE OFFICERS, SECURITY OFFICERS AND SERVICE PROVIDERS:-
(13) Under Section 5 the duties of a police officer, the Chief of Defense Staff, a service provider, and a Magistrate shall notify the aggrieved person of his or her right to apply for one or more exemptions under the Act, the availability of service services provider and defense officers; -1987 and his right to lodge an appeal under section 498A of the Indian Penal Code, where applicable. It is also assumed that this section will not relieve any police officer of his or her duty to continue in compliance with the law when he or she receives information on a clear criminal case.
(14) If an Abused person or on behalf of the Defense Officer or service provider asks the person in charge of the shelter to provide him or her with accommodation, that person in charge of the shelter will provide shelter to the victim in the home. As in the case of a person who is ill or on his or her behalf, the Defense Officer requests that he or she run a medical facility is obliged to provide medical assistance to the victim.
(15) This Act sets out the duties and functions of the Protection Officer to assist the Magistrate in performing his or her duties, to report domestic incidents to the Magistrate, and to apply to the Magistrate if the victim wishes to pray for a protection order, legal aid, access to safe shelter. if has examined the body, ensured that the order of financial exemption under Section 20 of the Act is complied with and complied with in accordance with the provisions of the Code of Criminal Procedure, 1973, and to perform other functions imposed by the Central Government, in accordance with the law. The Defense Officer shall be managed and supervised by a Magistrate and the State under and under the Act.
PROCEDURE FOR GETTING ORDER OR ASSISTANCE:-
(16) An aggrieved woman or Security Officer or other person representing the appellant may lodge an application with the Magistrate seeking one or more exemptions under the Act, who will usually set a date for the first hearing of the application within the date of admission and will attempt to dismiss all applications within 60 days of the first hearing. Section 12 of the said Act) This is due to the urgent need for the procedures under the Act to be completed as soon as possible. These are two distinct and important provisions of the Act. The Magistrate at any stage of the proceedings may direct the parties, either individually or collectively, to proceed advice to any of the members of the Service Provider who is so qualified as well experienced. A member of a counseling service provider shall have qualifications and experience that may be prescribed by the Central Government or by law, where any counsel is prescribed under this section of the Act, the Magistrate shall arrange the next hearing within a period not exceeding two months. According to G.R. dt. 30.10.2007 State Government has appointed its service provider to provide the following types of advice. (1) Counseling for the victim (2) Family Counseling (3) Counseling for a group of victims of Domestic Violence and Family Disputes. The Magistrate may protect the assistance of a person, preferably a woman, who works to promote the welfare of the family for the purposes of assisting the Court in performing its functions (Section 14 of the said Act). Procedures can be captured on camera if the other party so desires. The Magistrate, under the Act, is empowered to transfer the Protection Order, Residence Order. Financial Release, Custody orders compensation orders, temporary or exit commands. In terms of Rule 15 (6) of the Rules, the procedure to be followed must be followed. Under section 25 a magistrate may vary, alter, or revoke any order made by a person upon receipt of a victim's or defendant's application. Under Section 28 the Court may set out its procedure for dismissing an application for any rescue or eviction order. Under Section 24 of the Act the Court may issue free copies of the order to the application agencies, the police concerned, and service providers.
(17) Procedure for obtaining orders or resources provided under Sec. 12 of the Act. Under this Section, efforts have been made to simplify and implement the most effective way to lodge a complaint against domestic violence and to obtain relief from it. It also simplifies the victim's process so that if he or she wishes to lodge a complaint under this Act he or she can lodge it with any person or NG, who has witnessed domestic violence. Since domestic violence occurs within four walls of a house and is not visible to the public, to prevent the submission of malicious and non-statutory complaints, protection is provided under Section 1 of Section 12 by providing that before a Magistrate can pass a relief order under the Act However, at Shambhu Prasad Singh VsManjari, in the High Court of Delhi [MANU / DE / 0899/2012] - The issue arose that the first court issued a notice defendant on a complaint under section 12 of the Act without summoning a report of a domestic incident from the defendant. It was held that the call for a report of domestic incidents is not mandatory.
(18) The procedure for service of notice given under Section 13. The Magistrate's order shall be served on the respondent within two days or such extra time as the Magistrate may determine. In terms of Act 12 of the Protection of Women in the Domestic Violence Act, 2006, mechanisms for the provision of notices have been provided. Therefore, even police equipment can also be used as provided n Chapter VI of Cr.P.C. as far as possible.
(19) In any proceedings under this Act the Magistrate may protect the services of a person who is particularly vulnerable to a woman whether he or she is related to a victim or not, including a person involved in promoting family welfare for the purpose of assisting the Court in dismissal in terms of Section 15.
COURT ADMINISTRATION:-
(20) The first magistrate's court or metropolitan court be a competent court within the boundaries of the area:
(a) The victim is permanently or temporarily residing or conducting business or hired
(b) The respondent remains permanently or temporarily or conducts business or hired or
(c) The cause of the action appears.
Any order made under this Act shall be binding throughout India.
